The Website is owned and operated by Paula Diaco Enterprises, LLC DBA (“Write Stories Now”). The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Write Stories Now’s Privacy Policy) and procedures that may be published from time to time on this Site by Write Stories Now (collectively, the “Agreement”).
Please read these Terms of Service carefully before accessing or using the Website. By accessing or using any part of the web site, you agree to become bound by the terms and conditions of these Terms of Service. If you do not agree to all the terms and conditions of these Terms of Service, then you may not access the Website or use any services. If these terms and conditions are considered an offer by Write Stories Now, acceptance is expressly limited to these terms. The Website is available only to individuals who are at least 13 years old.
Your writestoriesnow.com Account and Site.
If you create a blog/site on the Website, you are responsible for maintaining the security of your account and blog, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the blog. You must not describe or assign keywords to your blog in a misleading or unlawful manner, including in a manner intended to trade on the name or reputation of others, and Write Stories Now may change or remove any description or keyword that it considers inappropriate or unlawful, or otherwise likely to cause Write Stories Now liability. Write Stories Now will not be liable for any acts or omissions by You, including any damages of any kind incurred as a result of such acts or omissions.
Responsibility of Contributors.
If you operate a blog, comment on a blog, post material to the Website, post links on the Website, or otherwise make (or allow any third party to make) material available by means of the Website (any such material, “Content”), You are entirely responsible for the content of, and any harm resulting from, that Content. That is the case regardless of whether the Content in question constitutes text, graphics, an audio file, or computer software.

For example, your blog’s URL or name is not the name of a person other than yourself or company other than your own; and you have, in the case of Content that includes computer code, accurately categorized and/or described the type, nature, uses and effects of the materials, whether requested to do so by Write Stories Now or otherwise.
By submitting Content to Write Stories Now for inclusion on your Website, you grant Write Stories Now a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting your blog. If you delete Content, Write Stories Now will use reasonable efforts to remove it from the Website, but you acknowledge that caching or references to the Content may not be made immediately unavailable.
Without limiting any of those representations or warranties, Write Stories Now has the right (though not the obligation) to, in Write Stories Now’s sole discretion (i) refuse or remove any content that, in Write Stories Now’s reasonable opinion, violates any Write Stories Now policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the Website to any individual or entity for any reason, in Write Stories Now’s sole discretion. Write Stories Now will have no obligation to provide a refund of any amounts previously paid.
Payment and Renewal
General Terms. By selecting any of our products programs, events or services, you agree to pay Write Stories Now the one-time and/or monthly or annual subscription fees indicated (additional payment terms may be included in other communications). Subscription payments will be charged on a pre-pay basis on the day you sign up for an Upgrade and will cover the use of that service for a monthly or annual subscription period as indicated. Payments are not refundable.
Payment Terms. Parties agree that any of our products programs, events or services to be rendered are in the nature of business writing and book writing coaching, consulting and educational Services Upon purchase of any of our products programs, events or services You shall be responsible for the full extent of the Fee, regardless of whether You completes all Services offered by Company. Company shall not be obligated to invoice You for payments. Company will provide You with payment receipts that will be sent via email to the email address of record. Your acceptance of these Terms of Service comprises your authorization of all charges set forth in these Terms of Service on the dates set forth herein. In the event that You terminate any of our products, programs, events or services prior to their completion, You shall remain responsible for the entire Fee set forth herein, which will become due immediately upon your termination of Company’s products programs, events or services. You acknowledge that, in the event of non-payment of fees when due, You shall be responsible for all costs of collection, including reasonable attorney’s fees and costs, and that any unpaid fees will be subject to collection.
Late Fees. Company shall charge a 5% (five-percent) late fee for all balances that are not paid in a timely manner by You. Any credit card charges that are declined are subject to a $25 fee.
Automatic Renewal. Unless you notify Write Stories Now before the end of the applicable subscription period that you want to cancel a subscription; your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee for such subscription (as well as any taxes) using any credit card or other payment mechanism we have on record for you. Upgrades can be canceled at any time by submitting your request to Write Stories Now in writing.
COMPANY’S SERVICES. Upon signup for any of our products programs, events or services and receipt of advance deposit from the You, the Company agrees to render those any of our products, programs, events or services as further described in an agreement between the Parties. The scope of any of our products, programs, events or services provided by Company pursuant to these Terms of Service shall be initially limited to those products, programs, events or services contained therein. Note that, the dates for any events (“Events”) (which may also include seminars, workshops, retreats, etc.) may be subject to change at Company’s sole discretion. Also, specific seminars/events may be at Company’s sole discretion. In no event, will such substitutions result in the diminution of value provided to You. Any additional products, programs, events or services provided by Company to You within these Terms of Service shall be subject to all of the terms and conditions of these Terms of Service.
Fees; Payment. By signing up for a Services account you agree to pay Write Stories Now the applicable setup fees and recurring fees. Applicable fees will be invoiced starting from the day your services are established and in advance of using such services.
SUPPORT If your service includes access to priority email support. “Email support” means the ability to make requests for technical support assistance by email at any time (with reasonable efforts by Write Stories Now to respond within one business day) concerning the use of the VIP Services. “Priority” means that support takes priority over support for users of the standard or free writestoriesnow.com services. All support will be provided in accordance with Write Stories Now standard services practices, procedures and policies.
Responsibility of Website Visitors. Write Stories Now has not reviewed, and cannot review, all of the material, including computer software, posted to the Website, and cannot therefore be responsible for that material’s content, use or effects. By operating the Website, Write Stories Now does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content.
The Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. Write Stories Now, writestoriesnow.com, the writestoriesnow.com logo, and all other trademarks, service marks, graphics and logos used in connection with writestoriesnow.com, or the Website are trademarks or registered trademarks of Write Stories Now or Write Stories Now’s licensors. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any Write Stories Now or third-party trademarks.
You acknowledge that all of our products, programs, events or services and materials provided pursuant to these Terms of Service are for the benefit of You only and are not transferable, either expressly or impliedly, without the written consent of Company. You acknowledge all such documentation and materials are protected by copyright and may not be reproduced, shared, duplicated, copied, sold, traded, disseminated, resold or exploited, electronically or otherwise, for any commercial or non-commercial purpose except with the express, written consent of Company. All such materials shall remain the sole property of Company, whether or not registered at the time of disclosure. You shall not use Company’s copyrighted materials to create any derivative products/materials. You agree that it will not use Company’s trademarks in any manner, whether personal or business. You agree that it will not allow use of, or access to, the Program/Events by any individual or company, other than You itself, without the express, written consent of Company.
CONFIDENTIALITY. Confidential Information includes but is not limited to, information and materials disclosed or provided in connection with these Terms of Service. Confidential information shall not include information that (a) is now or subsequently becomes generally available to the public; (b) the Company or You had rightfully in its possession prior to disclosure by the disclosing party; and/or (c) the Company or You rightfully obtains from a third party. Parties agree not to disclose, reveal or make use of any Confidential Information learned of through provision of Services pursuant to these Terms of Service, during discussions, coaching session(s), or otherwise without the express written consent of the disclosing party. Both You and Company shall keep the Confidential Information of the other in strictest confidence and shall use its best efforts to safeguard the disclosing party’s Confidential Information and to protect it against disclosure, misuse, loss and theft.
To the extent that You participates in group or one to one coaching Program/Events or interacts with other clients, you agree information received by You about other Company Your’ business writing and book writing coaching, consulting and educational Services shall be considered Confidential Information and not be disclosed without the prior written consent of the disclosing party.
Proprietary Information. For the purpose of these Terms of Service, “Proprietary Information” shall include, but not be limited to any information, observation, data, material, record, document, logo, system, promotional idea, customer list, customer need, practice, pricing information, process, market information, technique, trade secret, product, marketing, advertising, personal writing, business writing or finances of Company, its affiliates or related entities.
All right, title, and interest of every kind and nature whatsoever in and to the Proprietary Information made, written, discussed, developed, secured, obtained or learned by You during the term of the relationship with the Company or the Two (2) year period immediately following termination of that relationship, shall be the sole and exclusive property of Company for any purpose or use whatsoever, and shall be disclosed promptly by You to Company. The covenants set forth in the preceding sentence shall apply regardless of whether any Propriety Information is made, written, discussed, developed, secured, obtained or learned (a) solely or jointly with others, (b) during the usual hours of work or otherwise, (c) at the request and upon the suggestion of Company or otherwise, (d) with Company’s materials, tools, instruments, or (e) on Company’s premises or otherwise.
Advertisements. Write Stories Now reserves the right to display advertisements on your blog unless you have purchased an ad-free account.
Attribution. Write Stories Now reserves the right to display attribution links such as ‘Blog at writestoriesnow.com,’ theme author, and font attribution in your blog footer or toolbar.
Partner Products. By activating a partner product (e.g. theme) from one of our partners, you agree to that partner’s terms of service. You can opt out of their terms of service at any time by de-activating the partner product.
Domain Names. If you are registering a domain name, using or transferring a previously registered domain name, you acknowledge and agree that use of the domain name is also subject to the policies of the Internet Corporation for Assigned Names and Numbers (“ICANN”), including their Registration Rights and Responsibilities.
Changes. Write Stories Now reserves the right, at its sole discretion, to modify or replace any part of these Terms of Service. It is your responsibility to check these Terms of Service periodically for changes. Your continued use of or access to the Website following the posting of any changes to these Terms of Service constitutes acceptance of those changes. Write Stories Now may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of these Terms of Service.
Termination. Write Stories Now may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate these Terms of Service or your writestoriesnow.com account (if you have one), you may simply discontinue using the Website. Notwithstanding the foregoing, if you have a paid services account, such account can only be terminated by Write Stories Now if you materially breach these Terms of Service and fail to cure such breach within thirty (30) days from Write Stories Now’s notice to you thereof; provided that, Write Stories Now can terminate the Website immediately as part of a general shut down of our service. All provisions of these Terms of Service which by their nature should survive termination including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
These Terms of Service shall be continuing unless Company terminates these Terms of Service upon ten (10) days-notice. It may be terminated prior to the completion of the Program/Events or achievement of any previously agreed upon Scope of Work with or without cause.
In the event of failure by You to pay any amounts when they become due or any other default of these Terms of Service by You, all payments due hereunder shall become immediately due and payable. Company may, in its discretion, immediately terminate providing further Services to You and begin collection measures, as Company sees fit.
Disclaimer of Warranties. The Website is provided “as is”. Write Stories Now and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Write Stories Now nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.
DISCLAIMER OF GUARANTEE. You acknowledge that Company makes no guarantees regarding the outcome of the Services. Company provides or from your participation in the Program/Events. You accept and agrees that You is entirely responsible for its progress and results. Company makes no representations or guarantees verbally or in writing regarding performance of these Terms of Service other than those specifically enumerated herein. You accept that, due to the nature of Services provided hereunder, the results experienced by different clients may vary significantly. You accept responsibility for such variance. Company and its affiliates disclaim implied warranties of merchantability and fitness for a particular purpose.
Limitation of Liability. In no event will Write Stories Now, or its suppliers or licensors, be liable with respect to any subject matter of these Terms of Service under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to Write Stories Now under these Terms of Service during the twelve (12) month period prior to the cause of action. Write Stories Now shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
General Representation and Warranty. You represent and warrant that (i) your use of the Website will be in strict accordance with the Write Stories Now Privacy Policy, with these Terms of Service and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.
Indemnification. You agree to indemnify and hold harmless Write Stories Now, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of these Terms of Service.
Miscellaneous. These Terms of Service constitutes the entire agreement between Write Stories Now and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of Write Stories Now, or by the posting by Write Stories Now of a revised version.
Except to the extent applicable law, if any, provides otherwise, these Terms of Service, any access to or use of the Website will be governed by the laws of the Vermont, U.S.A., excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the state and federal courts located in Burlington, Vermont. Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under these Terms of Service shall be finally settled in accordance with the Comprehensive Arbitration Rules of the Judicial Arbitration and Mediation Service, Inc. (“JAMS”) by three arbitrators appointed in accordance with such Rules.
The arbitration shall take place in Burlington, Vermont, in the English language and the arbitral decision may be enforced in any court. The prevailing party in any action or proceeding to enforce these Terms of Service shall be entitled to costs and attorneys’ fees. If any part of these Terms of Service is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of these Terms of Service or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. You may assign your rights under these Terms of Service to any party that consents to, and agrees to be bound by, its terms and conditions; Write Stories Now may assign its rights under these Terms of Service without condition.
These Terms of Service will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.
SEVERABILITY. In the event that any of the provisions contained in these Terms of Service, or any part thereof, are hereafter construed by a court of competent jurisdiction to be invalid or unenforceable, the remainder of these Terms of Service shall remain in full force and effect.
Limited Effect of Waiver by Company. Should Company waive breach of any provision of these Terms of Service by the You, that waiver will not operate or be construed as a waiver of any further breach by the You.
